Refund policy

This Return and Refund Policy governs returns of products purchased through the store.dekesportswear.com website and its subdomains (collectively, the “Website”).

Products purchased through the Website are sold by Deke Sportswear (“Deke Sportswear,” “we,” “us,” or “our”).

By placing an order through the Website, you acknowledge and agree to this Return and Refund Policy and the other policies incorporated by reference. Nothing in this policy limits any rights or remedies that cannot be excluded under applicable law.

1. Requesting a Return Authorization

1.1 Return request deadline

To request a return, you must contact us by email at admin@dekesportswear.com within twenty (20) calendar days after receiving the product.

For orders containing multiple products delivered separately, the twenty-day period applies separately to each product from the date that product was received.

Your email must include:

Your full name and order number;
The product or products you wish to return;
The quantity of each product being returned;
The reason for the return; and
Photographs, where the product is alleged to be damaged, defective, or incorrect.

Do not send any product back to us until we have reviewed your request and issued a Return Authorization number.

1.2 Return Authorization number

If your return request is approved, we will provide you with a Return Authorization number (“RA Number”) and return-shipping instructions.

The RA Number must be:

Clearly and legibly written on the outside of the return parcel; and
Included on a copy of the packing slip or other document placed inside the parcel.

Only the products and quantities identified in the approved Return Authorization may be included in the parcel.

Returns sent without a valid RA Number, with an expired RA Number, to an unauthorized address, or without the RA Number clearly displayed on the outside of the parcel will be rejected by our warehouse receiving team. Rejected parcels may be returned to the sender at the sender’s expense.

The issuance of an RA Number does not guarantee that a return will be accepted. All returned products remain subject to inspection and the conditions set out in this policy.

1.3 Shipping your return

Returned products must be shipped:

From the same country to which the order was originally delivered; and
Within fourteen (14) calendar days after the date on which we issue the RA Number.

Unless the return results from a verified error by Deke Sportswear:

We do not provide prepaid return-shipping labels;
You are responsible for arranging and prepaying all return-shipping costs; and
You bear the risk of loss, delay, or damage until the returned parcel is delivered to us.

We strongly recommend using a traceable and insured shipping service and retaining your proof of dispatch and tracking information.

2. Return Conditions

A return will be accepted only where all of the following conditions are satisfied:

You requested the return within twenty (20) calendar days after receiving the product.
We issued a valid RA Number before the product was shipped back to us.
The parcel was dispatched within fourteen (14) calendar days after the RA Number was issued.
The RA Number is clearly displayed on the outside of the parcel.
The product is new, undamaged, unworn, and unwashed, except for reasonable handling necessary to assess its fit, appearance, and characteristics.
All original identification tags, labels, accessories, and disposable seals remain attached and intact.
The product is returned in its original packaging, where reasonably possible, together with the original packing slip or other proof of purchase.
The product is not excluded from return under Section 2.2.

Accepted returns will be refunded in accordance with Section 3.

2.1 Rejected or non-compliant returns

If a returned product does not satisfy this policy, we will notify you by email.

You may request that the product be shipped back to you, provided that you pay the applicable shipping and handling costs in advance.

If you decline re-delivery or fail to provide payment or instructions within thirty (30) calendar days after our notice, the product may, to the extent permitted by applicable law, be treated as abandoned and disposed of without compensation. No refund will be issued for a rejected or abandoned return.

2.2 Products that cannot be returned

Returns are not accepted for:

Sealed products that are not suitable for return for health or hygiene reasons after the seal has been removed;
Products that have been customized, personalized, altered, or manufactured to the customer’s specifications;
Products that, after delivery, have been inseparably mixed or combined with other products;
Digital goods or services after downloading, streaming, or electronic delivery has begun; or
Any other product identified as final sale or non-returnable before purchase, subject to applicable law.

2.3 Damaged, defective, or incorrect products

If you receive a product that is damaged, defective, or different from the product ordered, contact admin@dekesportswear.com promptly and provide your order number and clear photographs of the product and packaging.

Where we confirm that the product was damaged, defective, or incorrectly shipped by us, the 5% return processing fee will not apply. We will also provide appropriate return instructions and, where applicable, cover reasonable return-shipping costs.

3. Refunds

3.1 Inspection and refund timing

After we receive and inspect the returned product, we will notify you by email whether the return has been accepted or rejected.

For an accepted return, the applicable refund will be issued to the original form of payment within fourteen (14) calendar days after acceptance. Your bank, credit-card issuer, or payment provider may require additional time to post the refund to your account.

3.2 Five-percent return processing fee

Except for verified damaged, defective, or incorrectly shipped products, and except where prohibited by applicable law, all approved voluntary returns are subject to a 5% return processing fee.

This fee offsets non-refundable third-party payment-processing and return-administration costs and will be deducted from the amount otherwise eligible for refund.

For a return of an entire order, the fee is calculated on the total amount originally paid, including applicable taxes and original outbound shipping charges.

Example: If the total amount paid for an order was $100, including original shipping, the refund will be $95, provided that no additional deduction applies.

For a partial return:

The 5% fee will be calculated on the amount otherwise refundable for the returned product or products, including the applicable taxes; and
The original outbound shipping charge will not be refunded.

3.3 Other costs and deductions

Return-shipping costs paid by the customer are not reimbursable unless the return results from a verified error by Deke Sportswear.

Customs duties, brokerage charges, import fees, or similar amounts paid directly to a carrier, customs authority, or other third party are not refundable by Deke Sportswear.

We reserve the right to make an additional reasonable deduction where the value of a returned product has been reduced because of handling beyond what was reasonably necessary to assess its nature, characteristics, fit, or functioning.

Any refund or adjustment of applicable taxes will be processed in accordance with applicable law.

4. Exchanges

Deke Sportswear does not process direct product exchanges.

To obtain a different size, colour, or product, you must:

Request and complete a return in accordance with this policy; and
Place a new order through the Website.

The 5% return processing fee applies to returns made for the purpose of purchasing a different size, colour, or product.

As a courtesy, after your return has been accepted, we will email you a single-use free standard-shipping code for a replacement order placed within thirty (30) calendar days. The code applies to standard shipping within Canada and the contiguous United States only.

5. General Provisions

5.1 Entire agreement

This Return and Refund Policy, together with our Terms of Service, Shipping Policy, Privacy Policy, and any other policies incorporated by reference, constitutes the agreement between you and Deke Sportswear concerning product returns and refunds.

5.2 Severability

If any provision of this policy is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

5.3 Waiver

A failure or delay by either party in exercising a right under this policy does not constitute a waiver of that right. Any waiver must be made in writing by the party granting it.

5.4 Third-party rights

This policy is between Deke Sportswear and the customer. No third party has any right to enforce its provisions, except where otherwise required by law.

5.5 Language

To the extent permitted by applicable law, English is the authoritative language of this policy and related communications.

5.6 Effective date and policy changes

This policy applies to orders placed on or after the effective date shown above. Orders placed before that date will be governed by the return policy in effect when the order was placed.

We may update this policy from time to time by publishing a revised version on the Website. Changes will not be applied retroactively unless required by law.

Return parcels must not be shipped until an RA Number and return instructions have been issued.
